Deputy Emmet Stagg Deputy Emmet Stagg Deputy Emmet Stagg asked the Minister for the Environment, Heritage and Local Government if his attention has been drawn to the fact that the pension levy deductions are being applied to public servants who are not members of a public service scheme on analogous arrangements (details supplied); and if he will clarify the matter in regard to this issue. [10743/09] Deputy John Gormley Deputy John Gormley Deputy John Gormley: The Financial Emergency Measures in the Public Interest Act 2009 states that any public servant who is a member of a public service pension scheme, is entitled to a benefit under such a scheme, or receives a payment in lieu of membership in such a scheme, is subject to a deduction from their remuneration. In 1996, changes were introduced to the superannuation scheme affecting Non Officers, including part time employees. Part time employees were allowed to join the contributory Local Government (Superannuation Revision) (Consolidation) Scheme, 1986, on the same basis as it applies to other employees. Part time employees who did not wish to join the scheme had the Local Government (Superannuation) (Gratuities) (Amendment) Regulations, 1995 applied to them. This is a payment in lieu of membership of a pension scheme, and part time employees eligible for such a payment are subject to the deduction outlined in the Financial Emergency Measures in the Public Interest Act 2009.
