Ms O’Sullivan asked the Tánaiste and Minister for Justice, Equality and Law Reform his views on withdrawing the State’s appeal in relation to a judicial review decision in relation to a person (details supplied) in County Limerick who has applied for leave to remain in the State; and if he will make a statement on the matter.   Mr. McDowell: This applicant applied for asylum on 28th April, 2005. His application was refused and a Deportation Order was made on 21st July, 2005. The applicant instituted Judicial Review proceedings on 29th September, [453] 2005 challenging the Deportation Order made in respect of him and accordingly, as the matter is sub judice, I do not propose to comment further.
