Mr. Stanton Mr. Stanton Mr. Stanton asked the Minister for the Environment, Heritage and Local Government if an upper age limit applies regarding membership of State boards under his aegis; if so, the reason for the age limit; his plans to remove same; and if he will make a statement on the matter. [42080/06] Mr. Roche Mr. Roche Mr. Roche: An upper age limit of 65 years applies for any member of the Board of an agency under the aegis of my Department who is an employee of the agency and whose employment commenced before 1 April 2004. This arises because such an employee does not come within the scope of the definition of new entrant as set out in Section 2(1) of the Public Service Superannuation (Miscellaneous Provisions) Act 2004; Section 2(3) of that Act contains a general provision that a person who is a new entrant to the public service shall not be obliged to retire on age grounds. No age limit applies in relation to members of boards of agencies under my Department’s aegis who are not employees of the agency concerned.
