Mr. Sargent asked the Minister for the Environment, Heritage and Local Government if he has advised emanations of the State as to whether Directive 2003/4/EC has direct effect, notwithstanding the failure of the Government to transpose the directive within the prescribed timeframe.   Mr. Roche:The extent to which Directive 2003/4/EC in relation to access to information on the environment might be said to have direct effect is not clear, especially since transposition of certain significant provisions is discretionary. Work is continuing in my Department with a view to transposing the directive as soon as possible.
