  269. Mr. Naughten asked the Minister for Justice, Equality and Law Reform the procedure for a trainee garda applicant to have a medical refusal reviewed; and if he will make a statement on the matter. [14683/05]

  Mr. McDowell: I am advised by the Garda authorities that the circumstances of each case wherein the chief medical officer of the Garda Síochána is unable to issue a certificate of fitness differ. However, on receipt of a written application for review accompanied by a report from a treating specialist, the CMO reviews decisions on candidates who have been deemed unfit. Likewise, where an applicant has not yet been treated by a specialist, he may consult an independent specialist and obtain a report for onward transmission to the CMO, who will then review the case.
