118. Mr. Hogan asked the Minister for Agriculture, Food and Rural Development the reason a REP scheme application by a person (details supplied) in County Kilkenny was rejected in 1999; and if he will make a statement on the matter. [4424/00]

Minister for Agriculture, Food and Rural Development (Mr. Walsh): Following a compliance inspection on the holding of the person named in March 1998, a 100% penalty was imposed as nitrogen levels had been exceeded. This is a fundamental breach of the agri-environmental specifications and resulted in expulsion from the scheme.

The person named was requested to repay all moneys received under the scheme. However, a significant amount remains unpaid. In the circumstances, his application to rejoin the scheme was not accepted.
