345. Mr. Boylan asked the Minister for Justice, Equality and Law Reform when the Refugee Act, 1996, will be implemented as promised in An Action Programme for the Millennium; and if he will make a statement on the matter. [20494/97]

Minister for Justice, Equality and Law Reform (Mr. O'Donoghue): I have already made an Order commencing sections 1, 2, 5, 22 and 25 of the Refugee Act, 1996, with effect from 29 August last. There is at present a High Court injunction preventing the appointment of a Refugee Applications Commissioner under the Act. Because of this litigation I am not in a position to appoint a Refugee Applications Commissioner, an appointment central to the introduction of the remaining sections of the Act.
