79. Mr. Creed asked the the Minister for Equality and Law Reform the conditions and regulations which govern redundancy in situations where persons are on maternity leave and redundancy falls due in the middle of that leave; if he will give details of the position with any notice issued during the period of confinement; and if he will make a statement on the matter.

Minister for Equality and Law Reform (Mr. Taylor): Where a person is on maternity leave and her redundancy would otherwise fall due in the course of that leave the provisions of the Maternity [1318] Protection of Employees Act, 1981 apply to the effect that the date of the employee's dismissal or termination of employment under the Redundancy Payments Acts, 1967 to 1991, is deemed to be the date of her expected return to work, as duly notified to her employer in accordance with section 22 of the Maternity Protection of Employees Act, 1981 or, in the event that the date of her expected return to work has not yet been duly notified, the date on which she returns to work in accordance with section 10 of the Maternity Protection of Employees Act, 1981.
