106. Mr. O'Leary asked the Minister for Social Welfare when disability benefit will be granted on an appeal to a person (details supplied) in County Kerry in view of the fact that his doctor will not allow him to work under any circumstances; and if he will make a statement on the matter.

Minister for Social Welfare (Dr. Woods): It was decided in mid-December 1990 that the person concerned was not incapable of work and, therefore, not entitled to disability benefit. This decision was made following an examination by a medical referee.

Following an appeal, the person was seen by a different medical referee on 25 February 1991. The second medical referee also expressed the view that the person concerned is capable of work.

The case is now with the independent social welfare appeals office and it is [816] understood that an oral appeal hearing will be held in this case at the earliest possible date.
