65. Mr. McCartan asked the Minister for Justice the criteria used in determining exceptional circumstances, when deciding to disclose, whether a person or organisation is the subject of a Garda investigation.

Minister for Justice (Mr. Collins): It is not correct to infer, as this question does, that there are precise criteria for deciding when the circumstances of any particular case are sufficiently exceptional to warrant disclosure of whether or not a person or organisation is the subject of a Garda investigation. The practice has been for the Minister of the day to examine the circumstances of each case as it arises and to exercise his judgment in deciding whether disclosure is warranted.
