Mr. Quinn asked the Minister for the Environment if he has any proposals, in the interests of environmental management and improvement, to ban smoking in certain public areas such as buses, trains and public buildings. I have power under the Road Traffic [1302] Act, 1961, to make regulations in regard to the conduct of passengers in public service vehicles used on roads: the regulations made enable the operator of a large public service vehicle to prohibit, by notice, smoking in any part of the vehicle. Otherwise I have no power to prohibit smoking. The powers under the Local Government (Sanitary Services) Act, 1962, to make regulations controlling atmospheric pollution relate to air pollution resulting from the emission from premises of smoke and other pollutants.
