40. Dr. Browne and Mr. McQuillan asked the Minister for Lands whether the lay commissioners may be removed from office; and, if so, by whom and for what specific reasons; and if he will cite the statutory authority under which this power may be exercised.

Mr. Moran: The answer to the first part of the question is “yes”. The statutory authority is in section 28 of the Purchase of Land Act, 1891 as amended by section 4 of the Land Law (Commission) Act, 1923. The statutory reasons are “inability or misbehaviour”.Removal is subject to Order of the Government to be laid before the Oireachtas.
