Writ for By-Election — Motion.

Mr. P.S. Doyle: I move:—

That the Ceann Comhairle direct the Clerk of the Dáil to issue his writ for the election of a member to fill the vacancy which has occurred in the membership of the present Dáil consequent on the resignation by Deputy Finian Lynch of his seat as a member of the Constituency of South Kerry.

Mr. Donnellan: When may we expect the by-election to take place?

Mr. Dillon: Is there not a statutory provision that the returning officer must hold the election within a given time?

An Ceann Comhairle: That does not come within the province of the Chair.

Mr. Lemass: Within 21 days.

Mr. Dillon: We had to dig that out.

Mr. Lemass: The Deputy could have [380] gone to the Library and studied the Act for himself.

Mr. Dillon: I could, but the Minister is paid to do it.
